New Federal Accessibility Requirements for Medical Equipment

As of July 8, 2024, the U.S. Department of Health and Human Services (HHS) has updated Section 504 of the Rehabilitation Act. This update introduces strict new standards for Medical Diagnostic Equipment (MDE) to ensure patients with disabilities receive the same standard of care as those without.

The Hard Deadline: July 8, 2026
By this date, all physician practices receiving federal financial assistance (including Medicaid, CHIP, and Medicare) must have at least:

  • One accessible examination table (must lower to 17–19 inches).

  • One accessible weight scale (capable of weighing a patient in a wheelchair or via a lift).

TL/DR: What You Need to Know

  1. "Equivalent Care" is No Longer Enough: You can no longer fulfill your accessibility obligations by simply "helping" a patient or performing an exam in a wheelchair. If a non-disabled patient gets on a table for an exam, a disabled patient must have an accessible table available to do the same.

  2. Staff Training is Mandatory: Having the equipment isn't enough. Your staff must be trained on how to use the equipment safely and how to assist with patient transfers while maintaining the patient's dignity.

  3. New Purchases Must Comply: Any equipment (tables, scales, etc.) purchased or leased after July 8, 2024, must meet these accessibility standards until you meet the "10% rule" (where 10% of your total equipment of that type is accessible).

  4. Who is Affected? If you accept Medicaid, TRICARE, CHIP, or any HHS-funded program, you are legally required to comply. This covers the vast majority of pediatric and family practices.
